# Terms and Conditions – Lotex-SW Last Updated: October 14, 2026 Welcome to Lotex-SW, a technology service provided by Lotex through https://ai.lotex-dev.com. Please read these Terms and Conditions carefully before purchasing, activating, or using our service. By placing an order or using Lotex-SW, you acknowledge that you have read, understood, and agreed to these terms. - 1. Service Description Lotex-SW is a software service that enables website owners to integrate an AI-powered assistant, semantic search capabilities, website content understanding, automated visitor engagement, and intelligent recommendations. The service supports WordPress websites and certain custom-built websites and web applications, subject to technical compatibility. Available features may vary depending on website technology, integration requirements, and service configuration. - 2. Subscription and Pricing - The standard subscription fee is USD $40 per year per website. - Customers choosing the Lotex-provided Gemini account are charged an additional USD $10 per year, subject to applicable usage limits. - Customers may alternatively use their own Gemini API key and are responsible for any fees or restrictions imposed by Google. - Pricing may change in the future. Updated prices will be displayed before any new purchase or renewal. - Any applicable additional charges or taxes will be disclosed before payment. - 3. Activation and Licensing - Each website receives dedicated activation credentials after order verification and completion of subscription requirements. - Licenses are assigned to the registered website and may not be transferred, shared, or reused on other websites without authorization. - Customers must provide accurate website, business email, and contact information. - Lotex may request verification of website ownership or administrative authorization for security purposes. - Attempts to bypass activation mechanisms, licensing restrictions, or service security measures are prohibited. - 4. Subscription Period and Renewal Subscriptions remain active for 12 months from the service activation date unless otherwise specified at the time of purchase. Continued access after expiration requires subscription renewal and payment of the applicable fees. Automatic renewal charges will not be applied without the customer's explicit consent to an automatic renewal arrangement, where available. Certain service features may become unavailable when a subscription expires. - 5. Artificial Intelligence Disclaimer Some Lotex-SW features rely on third-party artificial intelligence technologies, including Google Gemini. Customers acknowledge that: - AI-generated responses may occasionally contain errors, inaccuracies, or incomplete information. - Response quality depends partly on the accuracy and relevance of website content and configured knowledge. - AI-generated content should not replace qualified professional advice regarding medical, legal, financial, or other sensitive matters. - Lotex does not guarantee the accuracy or suitability of every AI-generated response. - Third-party service availability, API changes, and provider policies may affect certain features. - 6. Fair Usage and Service Limits Lotex-SW applies technical and fair usage limits to maintain service stability, security, and performance. These limits may include API requests, AI resource consumption, request frequency, and website indexing volume. Using the Lotex-provided Gemini account does not constitute unlimited AI usage. Applicable usage allowances and restrictions are disclosed to customers. Lotex may temporarily restrict excessive or abnormal usage, with reasonable notice where practicable. - 7. Customer Responsibilities Customers are responsible for: - Ensuring they have the necessary rights to process and index their website content. - Maintaining accurate knowledge base information and assistant instructions. - Protecting account credentials and personal API keys. - Complying with applicable laws relating to website visitors and personal data. - Avoiding unlawful, harmful, fraudulent, or infringing uses of the service. - Providing appropriate privacy notices to their website visitors concerning AI interactions and data processing where required. - 8. Privacy and Data Protection Lotex respects customer privacy and processes information as reasonably necessary to operate, maintain, secure, and improve the reliability of its services. Processed information may include website details, indexed content, assistant configurations, user interactions, and technical operational data. When Gemini is used, information necessary to process AI requests may be transmitted to the relevant AI provider and may also be subject to that provider's terms and privacy policies. Customers retain ownership of their original website content and information. Using Lotex-SW does not transfer ownership of such content to Lotex. For further information, please refer to our published Privacy Policy. - 9. Payments, Cancellations, and Refunds Available payment methods are displayed during checkout. Payments must be completed using the official payment instructions provided by Lotex. Customers may request order cancellation and a refund before service activation, provided no non-recoverable dedicated resources or services have already been provisioned. Following activation, refund requests are reviewed based on individual circumstances, including material technical failures that cannot be resolved within a reasonable period, subject to applicable consumer protection laws. Canceling an active subscription does not automatically entitle the customer to a refund for unused subscription time. Customers may contact our support team to request cancellation or a refund. - 10. Service Availability and Support We strive to provide a stable and reliable service. However, uninterrupted or error-free availability cannot be guaranteed. Temporary interruptions may occur due to scheduled maintenance, software updates, hosting issues, third-party provider outages, or circumstances beyond our reasonable control. We make reasonable efforts to resolve issues within our responsibility but do not guarantee specific resolution times unless separately agreed. - 11. Intellectual Property All rights to the Lotex-SW software, designs, source code, branding, and proprietary technology belong to Lotex or their respective rights holders. Customers receive a limited right to use the service during their active subscription period. No ownership rights, redistribution rights, or resale permissions are granted unless expressly authorized. - 12. Suspension and Termination Lotex reserves the right to suspend or terminate access in cases of material violations, security abuse, unauthorized system access, or unpaid subscription fees. Where reasonably possible, customers will receive notice and an opportunity to resolve the issue, except where immediate action is required to protect the service or its users. - 13. Limitation of Liability To the maximum extent permitted by applicable law, Lotex shall not be liable for indirect losses, lost profits, business interruptions, or damages arising from inaccurate AI-generated content or service unavailability. Nothing in these terms excludes rights or liabilities that cannot legally be excluded. - 14. Changes to These Terms Lotex may update these Terms and Conditions to reflect operational, technical, legal, or service-related changes. Updated terms will be published with a revised modification date. Customers will be informed of material changes affecting their rights or obligations when appropriate. - 15.
